Computer Forensics in Support of Criminal Defense

The forensic examiner working on the Defense side has a very important role to play in the defense of the accused. When digital evidence is key in an investigation, it is important that the Defendant and his/her attorney have a detailed understanding of that evidence. Additionally, it is important to ensure that all the evidence available has been reviewed and being adequately presented to the trier of fact.

With the explosion in volume of digital evidence, the law enforcement examiners are under a lot of pressure to quickly finish exams and move on to the next case. This can sometimes lead to them being unable to spend the time required to go beyond substantiating the probable cause of the charges. Let me be clear, that this does not imply any intentional wrong on their part. This is more a function of an unrealistic work load that many law enforcement examiners have to deal with daily.

A talented examiner for the defense is able to confirm the law enforcement findings, if they are accurate, but also look at the evidence from a different perspective. This different perspective may be enhanced by the benefit of knowing the Defendant’s side of the story. The law enforcement examiner may not have had this alternate explanation to explore because the Defendant didn’t choose to make a statement or didn’t have the opportunity.

It is the job of the examiner for the defense to work with the Defendant and the Defendant’s attorney to create a total evaluation of the digital evidence in the case AND how it effects the case at hand. This is greatly enhanced by the investigative experience of the examiner. I have 15 years of hands on law enforcement experience. This experience included the areas of investigation: Internet Crimes Against Children (ICAC), Possession and Distribution of Child Pornography, CyberCrime, Financial Crime, Property Crimes, Street Crimes, Narcotics, Sex Crimes, and Homicide.
